An individual can seek a U-Visa if:
- He or she suffered physical or emotional abuse resulting from a qualifying crime.
- He or she has information about the crime.
- He or she is cooperative in the criminal investigation.
- The crime violated U.S. state or federal laws, or if the crime occurred in the U.S.
There are a limited number of U-Visas issued each year, and the process is full of obstacles, including obtaining proper certification from the applicable District Court or Police Department. Nevertheless, for certain people, the U-Visa option is a very realistic and valuable option. In certain circumstances, family members may be eligible for U-Derivative status as well.
